Public Forum - Reclassification of Fairland Hall

Tonight, 13 November at 6pm is a public hearing on reclassifying Fairland Hall (PP-2024-781) in order to deal with the land to the north below the cliff. The planning proposal is here:

The argument given is that the land is inaccessible and being maintained by the neighbours which council wants to regularise, and the community title is restrictive.

Now while it is true that license or lease community land is restricted to certain purposes and lengths under the current classification, it may be possible to lease the land to the adjacent owners already. For example if that part of the land is categorised as a natural area, it can be leased per 46(1)(b)(i) "to maintain the land... in its natural state and setting" under s36E of the Local Government Act, for up to 21 - 30 years. So the portion of land could just be categorised as community title, natural area to achieve this. A plan of management would make this clearer (it isn't clear why after 100 years there isn't one).


The land can of course be licensed or leased as operational land without restriction, and even then it does not need to be disposed of to deal with the issue of maintenance.

It is worth noting however that the entirety of the parcel is being proposed to be reclassified. This is not required for a part lot reclassification as illustrated by PP-2021-3110, picture below.

One might ask, why?
